Second Innings Consumer Health Data Privacy Policy
Second Innings, Inc.
Last updated November 1, 2026
1. ABOUT THIS POLICY
1.1 Who we are. This Consumer Health Data Privacy Policy is provided by Second Innings, Inc., a Delaware corporation, 9206 Sunshine Pl, Downey, CA 90240, USA ("Second Innings," "we," "us," or "our"). It applies to the Second Innings mobile applications, the website at secondinnings.app, and our other Services, as defined in our Terms of Service.
1.2 Laws this policy addresses. This policy is provided under the Washington My Health My Data Act (RCW 19.373), Nevada Senate Bill 370 (NRS Chapter 603A, consumer health data provisions), and the consumer health data provisions of the Connecticut Data Privacy Act (together, "Consumer Health Data Laws").
1.3 Who this policy applies to. This policy applies to "consumers" as defined by the Consumer Health Data Laws, including residents of Washington, Nevada, and Connecticut, and anyone whose consumer health data is collected in Washington. We may apply this policy to other members as well.
1.4 Relationship to our Privacy Policy. This policy supplements our Privacy Policy (secondinnings.app/privacy-policy) and is part of it. If this policy conflicts with the Privacy Policy as to consumer health data of a consumer covered by Section 1.3, this policy controls. Our Biometric Data Policy (secondinnings.app/biometric-policy) contains additional information about biometric data.
1.5 What "consumer health data" means. "Consumer health data" means personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status, as defined in the Consumer Health Data Laws. It can include information derived or inferred from information that is not itself about health.
2. CONSUMER HEALTH DATA WE COLLECT
Second Innings is a dating and relationship service. We do not provide health care, and you do not need to provide any health information to use the Services. Many questions in your profile and questionnaire are optional. Depending on what you choose to provide and the features you use, we may collect the following categories, which may be consumer health data:
| Category | Examples |
|---|---|
| Physical health, fitness, and body measurements | Fitness and health answers, exercise habits, height, weight, body type, and dietary needs or preferences that relate to health |
| Emotional and mental wellbeing | Answers about your current emotional state, readiness for a relationship, how you handle stress and setbacks, and your attachment style |
| Therapy or counseling history | Whether you sought therapy or counseling, for example after a relationship ended |
| Intimacy and sexual health | Answers about the importance of intimacy and related preferences |
| Substance use | Answers about drinking, smoking, and similar habits |
| Health information you write | Health or wellbeing information you include in free-text profile sections (such as "About Me" or "My Story"), in messages to other members, or in Inputs to the AI Companion and other AI Features |
| Biometric data | Face templates and facial analysis results derived from your profile photos and selfies for safety, fraud prevention, duplicate-account detection, age assurance, and verification, as described in our Biometric Data Policy |
| Inferences | Information we or our systems derive from the categories above or from other information, such as compatibility scores, Match Meter categories, relationship readiness signals, recommendations, and astrology content that refers to health or wellbeing, to the extent that such information identifies your health status |
Location. We collect location information as described in our Privacy Policy, for example to show nearby profiles. We do not use location information to identify or infer whether you are seeking or receiving health care services.
3. SOURCES OF CONSUMER HEALTH DATA
We collect consumer health data from the following categories of sources:
- You, when you answer optional questions, write profile sections, send messages, use AI Features, or upload photos and selfies;
- Our own systems, which derive inferences such as compatibility scores and recommendations;
- Service providers (processors) that analyze photos and selfies or review text on our behalf and return results to us; and
- Other members, for example where a member includes information about you in a message or a report.
4. HOW WE USE CONSUMER HEALTH DATA
We collect and use consumer health data only with your consent or to the extent necessary to provide a product or service you have requested, for the following purposes:
- Your profile and matching: to build and display your profile, and to provide matching, ranking, recommendations, filters, Smart Match, ReMatch AI, Match Meter, compatibility, and other features you use;
- Display to other members: to show your answers to other members where you choose to display them, including in compatibility features that compare your answers with theirs;
- AI Features: to generate replies to your Inputs and, if you use language suggesting a risk of harm, to show crisis resources (when the AI Companion shows crisis resources, we count the event without its content);
- Safety, verification, and age assurance: to moderate free text and photos, detect fraud, impersonation, and duplicate or banned accounts, verify photos, and confirm that members are 18 or older;
- Security and integrity: to protect the Services and our members;
- Legal compliance: to comply with law and legal process, respond to lawful requests, and establish, exercise, or defend legal claims; and
- Improvement: to evaluate and improve the Services using aggregated or de-identified information.
We do not use consumer health data for advertising, and we do not provide it to advertising partners.
5. CONSENT
5.1 Optional health answers and free text. By choosing to answer optional questions that may be consumer health data, or by including health information in free text, messages, or AI Inputs, you consent to our collection and use of that information for the purposes described in Section 4, and to its disclosure as described in Section 6, including to other members where you choose to display it. If you do not consent, do not provide that information. Not providing it does not prevent you from using the Services, although some compatibility features may be less complete.
5.2 Biometric data. We process biometric data based on the consent you give when you check the box at signup agreeing to our Terms of Service, Privacy Policy, and Biometric Data Policy, including face analysis of your photos and selfies.
5.3 Withdrawing consent. You can withdraw your consent at any time by deleting the relevant answers or content in the app, deleting your account, or contacting privacy@secondinnings.app as described in Section 9. Withdrawing consent does not affect processing that took place before you withdrew it. If you withdraw consent to biometric processing, some features, such as verification, may no longer be available.
6. HOW WE SHARE CONSUMER HEALTH DATA
6.1 Categories of consumer health data shared. We may share any of the categories described in Section 2, as described below.
6.2 Categories of recipients.
| Recipient | What may be shared | Why |
|---|---|---|
| Other members, at your direction | Answers and profile content you choose to display, compatibility results that use your answers, and messages you send | To provide the profile, compatibility, and messaging features you use |
| Processors (service providers acting on our behalf), including cloud hosting and storage providers (such as Amazon Web Services), AI model providers that review profile text and generate AI Companion replies (such as OpenRouter and OpenAI), and face analysis and age estimation providers (such as Amazon Web Services and EveryPixel) | The information needed for the service they perform | To host the Services, moderate content, provide AI Features, and perform face analysis and age estimation, under contracts that limit their use of the data to providing services to us |
| Legal, safety, and law enforcement recipients | Information relevant to the request or situation | To comply with law, legal process, or a governmental request, protect the safety of members and others, and establish, exercise, or defend legal claims, as described in our Privacy Policy and Law Enforcement Guidelines |
| Successors in a business transaction | Consumer health data held as part of the transferred business | In connection with a merger, acquisition, sale, transfer of the Services, wind-down, or similar transaction, subject to the Consumer Health Data Laws |
6.3 Affiliates. We do not currently share consumer health data with affiliates. If we do, we will update this policy.
6.4 AI model providers. AI model providers that process consumer health data on our behalf are not permitted to train their models on it. We do not use consumer health data to train generalized AI models made available to third parties. Your AI Companion chat history is stored only on your device, not on our servers.
6.5 Access within Second Innings. We limit access to consumer health data to personnel and contractors who need it for the purposes in Section 4, with role-based access controls and confidentiality obligations.
7. NO SALE OF CONSUMER HEALTH DATA
We do not sell consumer health data. If we ever wished to do so, we would first obtain your valid authorization as required by the Consumer Health Data Laws.
8. NO GEOFENCING
We do not implement a geofence around any facility that provides in-person health care services to identify, track, collect data from, or send notifications or advertisements to consumers.
9. YOUR RIGHTS
9.1 Rights. Subject to the Consumer Health Data Laws, you have the right to:
- Confirm whether we collect, share, or sell your consumer health data;
- Access your consumer health data, including a list of all third parties and affiliates with whom we have shared or sold it and an active email address or other online mechanism you can use to contact them;
- Withdraw consent to our collection and sharing of your consumer health data;
- Delete your consumer health data. When we receive a verified deletion request, we will delete your consumer health data from our records, including from archived or backup systems within the time the law allows, and notify our processors and any third parties with which we shared it; and
- Appeal our decision on your request.
9.2 No discrimination. We will not discriminate against you for exercising these rights.
9.3 How to exercise your rights.
- In the app: you can edit or delete optional answers and profile content at any time, request a copy of your data at Settings > Your Privacy Choices > Download my data, and delete your account in settings. Account deletion has a 14-day grace period, during which you can cancel by signing in again, after which we erase your account as described in Section 11 of our Privacy Policy.
- By email: send your request to privacy@secondinnings.app with the subject line "Consumer Health Data Request," and tell us which right you want to exercise and the email address or phone number associated with your account.
9.4 Verification and authorized agents. We will verify your identity before acting on a request, for example by confirming control of the email address or phone number on your account. Where the law allows, an authorized agent may submit a request on your behalf with your signed written permission, and we may ask you to verify your identity directly.
9.5 Timing and fees. We will respond within 45 days after receiving your request. If reasonably necessary, we may extend this period once by an additional 45 days, and we will tell you why. We do not charge for requests, except that, where the law allows, we may charge a reasonable fee or decline a request that is manifestly unfounded, excessive, or repetitive, including more than two requests in a 12-month period.
9.6 Appeals. If we decline to take action on your request, you may appeal by replying to our response or by emailing privacy@secondinnings.app with the subject line "Consumer Health Data Appeal" within a reasonable period after our decision. We will respond to your appeal within the time required by law and explain our decision. If your appeal is denied, you may contact:
- the Washington State Attorney General at atg.wa.gov;
- the Nevada Attorney General at ag.nv.gov; or
- the Connecticut Attorney General at portal.ct.gov/ag.
10. RETENTION
We keep consumer health data for as long as it is part of your profile or account and as needed for the purposes in Section 4. When you delete an answer, it is removed from your profile and matching, and copies may remain in history records and backups until your account is erased or they are deleted in the ordinary course. When your account is erased after the 14-day grace period, we delete or anonymize your consumer health data, except where we must keep information for the limited purposes and periods described in Section 11 of our Privacy Policy (for example, child-safety evidence or legal holds). Biometric data is retained and destroyed as described in our Biometric Data Policy.
11. SECURITY
We use administrative, technical, and organizational measures designed to protect consumer health data, as described in Section 12 of our Privacy Policy. No method of transmission or storage is completely secure.
12. CHANGES TO THIS POLICY
We may update this policy from time to time. We will post the updated version on our website and update the "Last Updated" date. If we make a material change, including to collect or share consumer health data for a purpose not described here, we will notify you in advance and obtain your consent where required by law.
